The Dangers of Excessive Executive Power and Possible Solutions

As a constitutional democratic country, Australia is based on the separation of powers, and the expansion of executive power poses a threat to the balance of power. This article explores the nature and sources of federal administrative power, and points out the problem of its blurred boundaries. Unrestricted administrative discretion carries risks such as weakened parliamentary oversight and weakened federalism. In this regard, reform measures such as limiting the breadth and depth of state power, strengthening judicial review, enhancing transparency and citizen participation can be taken to rebalance administrative power within the framework of the Australian Constitution, in order to maintain the separation of powers and democratic governance.
